Prices, rates, and service descriptions displayed on this Site (including our instant quote tool) are provided for informational and estimation purposes only. They do not constitute a binding offer. Actual pricing is determined through a signed estimate or service agreement specific to your property, scope of work, and conditions. We reserve the right to update displayed pricing at any time without notice.

6. Payment Terms

Payments for services are processed through Stripe. By making a payment through the Site, you agree to Stripe's terms of service. Specific payment terms — including deposit requirements, due dates, late fees, and refund policies — are detailed in your individual service agreement or estimate.

7. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

This disclaimer applies to the website only. Warranties for our physical services (pressure washing and landscaping) are set forth in your signed service agreement.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY GEORGIA LAW, FIRM FOUNDATION PROPERTY SERVICES, ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

This liability cap applies to the website and its content. Liability related to the performance of physical services is governed separately by your signed service agreement.

9. Indemnification

You agree to indemnify, defend, and hold harmless Firm Foundation Property Services, its owners, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use or misuse of the Site; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party right.

10. Dispute Resolution

If a dispute arises from your use of the Site, both parties agree to first attempt resolution through good-faith negotiation for a period of thirty (30) days. Either party may initiate this process by sending written notice to the other party describing the dispute and proposed resolution.

If the dispute cannot be resolved informally within 30 days, either party may pursue legal remedies as described in Section 11.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Georgia for the resolution of any disputes arising from these Terms or your use of the Site.

12. Severability

If any provision of these Terms is held to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

13. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Firm Foundation Property Services regarding your use of the Site. These Terms do not alter or supersede any signed service agreement, estimate, or invoice between you and Firm Foundation Property Services for the performance of physical services.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the Site after any changes constitutes acceptance of the revised Terms. Material changes will be communicated to active customers by email.
